Policy And Procedures For DMCA Notice And Takedown

This Digital Millennium Copyright Act policy (“Policy”) applies to the fullthrottlealways.com website (“Website”), “fullthrottlealways.com” mobile application (“Mobile Application”), and any of their related products and services (collectively, “Services”) and outlines how this Website operator and Mobile Application developer (“Operator”, “we”, “us” or “our”) addresses copyright infringement notifications and how you (“you” or “your”) may submit a copyright infringement complaint.

Protection of intellectual property is of utmost importance to us and we ask our users and their authorized agents to do the same. It is our policy to expeditiously respond to clear notifications of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (“DMCA”) of 1998, the text of which can be found at the U.S. Copyright Office website. As a result, we comply with the DMCA and have implemented the following Notice and Takedown Policy in response to claims of copyright infringement by our members, subscribers, or users.

Notification Of Alleged Infringement

If you believe that your work has been copied in a way that constitutes copyright infringement, please provide the following information to Our Designated Copyright Agent (identified below):

  • I. The electronic or physical signature of the person authorised to act on behalf of the copyright or other intellectual property interest owner;
  • II. A description of the allegedly infringed copyrighted work or other intellectual property;
  • III. A description of where the allegedly infringing material is located on the SITE (preferably including specific URLs associated with the material);
  • IV. Your mailing address, phone number, and email address;
  • V. A statement from you that you believe the disputed use is not authorised by the copyright owner;
  • VI. a statement made under penalty of perjury by you that the above information in your Notice is correct and that you are the copyright or intellectual property owner or have authority to act on the copyright or intellectual property owner’s behalf.

The DMCA Takedown Process

A copyright owner complains to Full Throttle Always about a User, stating particular content hosted by the Full Throttle Always Website or Services that the members claim infringes on his or her copyright. If it is properly prepared, we forward the complaint to the member connected with the specified content. If the member disagrees with the complaint, he or she may alert Full Throttle Always of the disagreement. Other than establishing whether the notifications fit the DMCA’s basic standards, Full Throttle Always has limited discretion in the process. The parties (and their attorneys) must assess the merits of their claims, keeping in mind that notifications must be submitted under penalty of perjury.

The process is as follows –

A. The process entails the copyright sending a DMCA takedown notice to Full Throttle Always by the copyright owner.
B. Full Throttle Always notifies the member who is accountable for the infringement.
C. Access to the Content may be disabled by Full Throttle Always.
D. Member can write a counter notice to the Full Throttle Always indicating why he/she disagree with the copyright owner. we will add it to our public repository and forward the notice to the copyright owner by providing the URL to the copyright owner.
E. The owner of the copyright may take legal action.

Counter-Notification

A member may file a counter-notification under Section 512(g)(2)&(3) of the DMCA to the Full Throttle Always indicating why he/she disagrees with the copyright owner.

To file an appeal, please provide the designated copyright agent with the following information –

A. Identification of the item that has been removed or access to which has been restricted, as well as the place where the material appeared before it was deleted or restricted;
B. Under penalty of perjury, a declaration that you have a good faith conviction that the item was deleted or disabled as a consequence of a mistake or misidentification of the material in question;
C. Your full name, address, and phone number;
D. Include the statement: “I consent to the jurisdiction of Federal District Court for the judicial district in which my address is located (if in the United States, otherwise the Central District of California, where Full Throttle Always is located), and I will accept service of process from the person who provided the DMCA notification or an agent of such person.”;
E. Your signature, either physical or electronic.

Changes And Amendments

We reserve the right to modify this Policy or its terms related to the Services at any time at our discretion. When we do, we will revise the updated date at the bottom of this page, post a notification within the Services, send you an email to notify you. We may also provide notice to you in other ways at our discretion, such as through the contact information you have provided.

An updated version of this Policy will be effective immediately upon the posting of the revised Policy unless otherwise specified. Your continued use of the Services after the effective date of the revised Policy (or such other act specified at that time) will constitute your consent to those changes.
